Upcoming Worker's Compensation Rate Improvements, An Analysis of the California Worker's Compensation Insurance Market
An analysis of historical Worker’s Compensation premium prices and data related to two of the major class codes, 8829 and 9070, associated with BRMS clients such as Assisted Living and Nursing Home facilities.
Employment Practices Liabilty Exposure
Employment Practices Liability has become
one of the leading exposures that threaten
nursing homes, assisted living facilities, home
health care agencies and other long term
care providers. The long term care industry
suffers from a relatively high incidence of
Employment Practices Liability (EPL) claims.
There are several underlying factors which
contribute to this phenomenon.
Admitted Lines vs. Surplus Lines
BRMS Insurance Services has been appointed
by GuideOne Insurance®, an “A”1 rated insurance
carrier, to offer admitted liability insurance to
California’s best nursing homes and assisted living
facilities. Until this product entered the California
marketplace, long-term care facilities were, for
the most part, left with less attractive alternatives

is available, first-class administrators and other
long-term care executives must acquire a basic

California Workers Compensation: Rough Waters Ahead
It is common knowledge among insurance professionals that
insurance premiums continuously rise and fall over time in a
loose pattern called “The Underwriting Cycle.” There are three
main factors that affect this cycle: Competition, Government
Action, and Loss Control Efforts.
OSHA Scrutiny of LTC Facility
On September 30, 2009, the Occupational Safety
and Health Administration (OSHA) issued a
directive to establish procedures for increased
employer inspections in high injury businesses
(e.g. nursing homes and other long term care
facilities), who report low rates of injury. (www.
08.pdf) On September 28, 2010, the developed
procedures were put into practice. Thus began a
national effort to plan and carryout inspections
that focus on recordkeeping. (www.osha.gov/
April 5, 2012 OSHA initiated a program to focus
resource specifically on the inspection of care facilities.
